1. Agreement and Acceptance
These Terms of Use (“Terms”) govern your access to and use of s-curity.com and its public pages, materials, forms, and other features (the “Website”). The Website is operated by S-Curity LLC (“S-Curity,” “we,” “us,” or “our”), an associated company of VDHOSTS INTERNET PRIVATE LIMITED. By accessing or using the Website, you agree to these Terms. If you do not agree, do not use the Website.
These Terms govern the public Website only. A paid product, cybersecurity engagement, software subscription, assessment, penetration test, managed service, or other deliverable may be governed by a separate signed agreement, statement of work, order form, acceptable-use policy, service-level agreement, or data processing agreement. If a separate agreement conflicts with these Terms regarding the contracted service, the separate agreement controls to the extent of the conflict.
2. Eligibility and Authority
You may use the Website only in compliance with applicable law. If you use it on behalf of a company or other organisation, you represent that you are authorised to bind that organisation to these Terms, and “you” includes that organisation. You must not use the Website if doing so would violate a legal restriction applicable to you.
3. Website Information and Product Status
The Website provides general information about S-Curity, cybersecurity topics, products, planned capabilities, and services. Unless expressly stated in a signed agreement or order, descriptions, roadmaps, features, availability, pricing, timelines, performance statements, and other materials are informational and may change without notice. A description of a feature does not guarantee that the feature is currently available, suitable for a particular environment, or included in a particular service. Nothing on the Website constitutes a binding offer unless expressly identified as such.
4. Permitted Use
You may use the Website for lawful informational, evaluation, and business communication purposes. You agree not to:
- violate any applicable law, regulation, court order, or third-party right;
- attempt unauthorised access to the Website, its servers, accounts, systems, networks, or connected infrastructure;
- probe, scan, test, exploit, disrupt, overload, or interfere with systems without express written authorisation from the relevant owner;
- upload malware, malicious code, spam, unlawful content, or material designed to compromise security or availability;
- misrepresent your identity, affiliation, authority, or the origin of a communication;
- scrape, harvest, copy, or extract Website content at scale using automated means, except where permitted by law or our written permission;
- reverse engineer, decompile, or attempt to derive source code from Website software except to the extent such restriction is prohibited by applicable law;
- bypass access controls, rate limits, or security mechanisms; or
- use the Website to transmit confidential, regulated, or sensitive information without an appropriate secure channel and prior agreement.
5. Cybersecurity Services and Testing Authorisation
Website access is not permission to test a system. Nothing in these Terms authorises you to scan, test, access, exploit, or otherwise interact with any S-Curity or third-party system beyond ordinary use of the public Website. Security assessments, penetration testing, vulnerability validation, incident response, and other technical work must be covered by a written scope from an authorised party. The scope should identify the systems, permitted techniques, testing window, emergency contacts, data-handling rules, and stop conditions. You must not access or retain data that does not belong to you.
6. Intellectual Property
The Website and its content, including text, graphics, logos, designs, software, layouts, and other materials, are owned by S-Curity or its licensors and are protected by intellectual property laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable licence to access and view the Website for its intended purpose. No ownership rights are transferred. You may not reproduce, distribute, modify, publicly display, commercially exploit, or create derivative works from Website materials without prior written permission, except as permitted by law. Third-party names and marks belong to their respective owners.
7. User Submissions
If you submit feedback, suggestions, or general enquiries, you represent that you have the right to submit them and that doing so does not breach a duty owed to another person. Do not submit trade secrets, source code, credentials, vulnerability details about third-party systems, or confidential material unless an authorised written process is in place. Except for personal information handled under our Privacy Notice, you grant us a non-exclusive, worldwide, royalty-free right to use general feedback to improve our offerings, without obligation to you, provided we do not thereby disclose your confidential information contrary to an applicable written agreement.
8. Third-Party Links and Services
The Website may contain links to third-party websites, tools, platforms, or resources. Links are provided for convenience and do not imply endorsement. We do not control or warrant third-party content, availability, security, or privacy practices. Your use of third-party services is at your own risk and subject to their terms.
9. Disclaimers
To the maximum extent permitted by applicable law, the Website and its content are provided on an “as is” and “as available” basis. S-Curity disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade. We do not warrant that the Website will be uninterrupted, error-free, secure, current, or free of harmful components, or that information on it will be complete or suitable for every purpose.
Cybersecurity information and assessments are inherently time-sensitive. No security control, product, assessment, or service can guarantee that all vulnerabilities, attacks, incidents, or losses will be prevented or detected. Do not rely on general Website content as a substitute for professional advice, a risk assessment, or a written service agreement tailored to your environment.
10. Limitation of Liability
To the maximum extent permitted by law, S-Curity and its affiliates, officers, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of profits, revenue, business opportunity, goodwill, data, or business interruption arising out of or related to Website use, even if advised of the possibility of such loss. To the maximum extent permitted by law, our aggregate liability arising from or related to the public Website will not exceed the greater of (a) the amount, if any, you paid directly to S-Curity solely for access to the Website during the three months before the event giving rise to the claim, or (b) USD 100. This limitation does not apply where liability cannot lawfully be excluded or limited, including any non-waivable statutory rights. Separate signed service agreements may contain different liability provisions for contracted services.
11. Indemnity
To the extent permitted by applicable law, you agree to indemnify and hold harmless S-Curity and its affiliates, officers, employees, and agents from third-party claims, liabilities, losses, and reasonable expenses arising from your unlawful use of the Website, your breach of these Terms, or your infringement of another person's rights. This clause does not apply to the extent a claim results from our own conduct where such indemnity would be unlawful.
12. Suspension and Changes
We may modify, suspend, or discontinue any part of the Website at any time, including for maintenance, security, legal, or operational reasons. We may restrict access where reasonably necessary to protect the Website, users, or third parties. We may update these Terms by publishing a revised version with a new “Last updated” date. Changes apply prospectively from publication unless applicable law requires otherwise. Your continued use after an update constitutes acceptance of the revised Terms to the extent permitted by law.
13. Governing Law and Disputes
These Terms are subject to applicable law. Any dispute will be brought before a court or tribunal of competent jurisdiction, subject to mandatory consumer-protection and other non-waivable rights. Nothing in this section prevents either party from seeking urgent injunctive or equitable relief from a court with jurisdiction. The appropriate governing law and venue may also be specified in a separate written agreement between you and S-Curity for a particular service.
14. General Provisions
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the extent permitted by law. A failure to enforce a provision is not a waiver. You may not assign these Terms without our prior written consent; we may assign them as part of a merger, restructuring, or transfer of relevant business assets, subject to applicable law. These Terms and any applicable separate agreement constitute the agreement between you and us regarding the subject matter addressed here. Provisions that by their nature should survive termination will survive.
